The 9th U.S. Circuit Court of Appeals (San Francisco) upheld a Hawaii law that requires employees to have a degree of loyalty, especially regarding competing against their employers. Hawaii U.S. District Judge Helen Gillmor had ruled that two employees with EBI (Eckard Brandes, Inc.) breached their loyalty when they formed a company to directly compete with their employer and won a contract in Hawaii County in 1996 involving sewer pipes. The two employees originated a suit in state court for overtime pay and their employer filed a counterclaim in federal court. Gillmor granted EBI summary judgement on the claim for overtime and the duty of loyalty claim and ordered the two employees to pay their profits on the project ã as well as legal costs ã to their employer. The Court of Appeals upheld this judgment as well as the viability of the loyalty provision.
